Non Advised Service

Rosey Futures website service is ‘Non-advised’ which means it relies on you to answer a small number of questions, the answers to which it uses to search a range of leading protection providers. The system will then present you with a range of alternatives and accompanying information so you can make an informed decision.

Please note that we do not offer a non-advised service in relation to our services for Investments and Pensions.

The website service won’t assess the personal information you provide relevant to your needs or make any recommendation about which protection policy is suitable. It is your responsibility to choose which is the best option for you.

Alternatively, if you feel that you need advice we can arrange for you to talk with an adviser who will be able to make a personal recommendation. Where it applies, any subsequent advice or recommendation offered to you will be based on your stated objectives and circumstances. Customer Categorisation

Unless we notify you in writing to the contrary we will treat you as a retail client for pensions and investment business and a consumer for non-investment protection contracts. This means you are afforded the highest level of protection under the regulatory system and should have the right to take any complaint to the Financial Ombudsman Service. Although we would warn that the Financial Ombudsman Service does not generally consider cases where no advice has been offered or received.

Complaints

If you cannot settle your complaint with us, you may be entitled to refer it to the independent adjudicator of complaints, the Financial Ombudsman Service (FOS) if you meet the FOS’s eligibility criteria. Communications

We will communicate with you in English both verbally and written for the sending and reception of orders. To avoid any doubt instructions should be issued in writing.

Right to Cancel

You have a period of days in which you can review and consider your options. You should check the provider literature to confirm the date that this period commences and any charges that may apply following cancellation and (where applicable) the method of exercising your rights.

Identity Verification

We will need to verify your identity and where possible this will be done via an Electronic Identity Checking Service. You should note that although we check your identity electronically in some cases we may still need to request to see original identification documents.

Law

This Customer agreement is governed and shall be construed in accordance with English Law and the parties shall submit to the exclusive jurisdiction of the English Courts.

Force Majeure

Rosey Futures shall not be in breach of this Agreement and shall not incur any liability to you if there is any failure to perform its duties due to any circumstances reasonably beyond its control.

Termination

The authority to act on your behalf may be terminated at any time without penalty by either party giving seven days notice in writing to that effect to the other, but without prejudice to the completion of transactions already initiated.

The Distance Marketing Directive

The Distance Marketing Directive normally grants you 30 days in which you may cancel a life policy.

Privacy Policy

The purpose of this Notice

As part of our arrangement with you, Rosey Futures has certain obligations under privacy laws, including the Data Protection Act (the “Act”) to notify individuals how it will process any personal information it collects about them. Steps will be taken to ensure that the information is accurate, kept up to date and not kept for longer than is necessary. Measures will also be taken to safeguard against unauthorised or unlawful processing and accidental loss or destruction or damage to the information.

What type of personal information will be processed?

We collect information from you when you register on our site, speak to one of our representatives or fill out a form for the purposes of providing services which are explained in more detail below. “Processing” is defined in the Act but could include obtaining, recording or holding information or data. “Personal data” is information which can identify you as a living individual, including where used in conjunction with other information. Common examples of personal data which may be collected and used by us in our day to day business activities include: name, date of birth, gender, ethnicity, marital status, address, telephone number and other contact details (including email addresses), job title, bank account and other financial details.

Information collected and processed may also contain “sensitive personal data” for the purposes of the Act, examples of likely items which may contain sensitive personal data (although this is not an exhaustive list) are life insurance questionnaires and medical reports. Please note that as with personal data, you have freedom of choice when it comes to your decision as to whether you provide us with sensitive personal data. In addition to your right to request that we stop processing your personal data and sensitive personal data at any time, you have an opportunity at the end of this Notice to choose not to provide sensitive personal data to us at all.

You should however note that if you exercise this right or subsequently request that we stop processing all or part of your personal data and/or sensitive personal data, this could impact upon our ability to provide you with certain types of product and services and may ultimately result in us being unable to provide them to you at all.

How will my personal data be collected and used?

We may process your personal data and sensitive personal data for the following reasons:
